These General Conditions of Use (hereinafter, “the General Conditions”) govern, together with the Privacy Policy, access and use, by the User, of the https://bestofspain.org Website (hereinafter,, “The BeOS Web”). Through acceptance, of these General Conditions; The User states:

The use of The BeOS Web Website attributes the condition of User of the Website (hereinafter, “the User”) and implies the acceptance of all the terms included in these General Conditions. The User must read these General Conditions carefully each time they access the Website, as this and these General Conditions may be modified.

The owner of The BeOS Web reserves the right to make, at any time and without prior notice, any modification or update of its contents and services; of these General Conditions and, in general, how many elements make up the design and configuration of The BeOS Web.

1.- Access to the site

BeOS is an exclusive relationship system for people over 16 years old.

The main objective of BeOS is that Spain is the common link of all those people, who are looking for a tourist destination, a cultural exchange, business units, residence, information on regional meetings, thematic groups (Spanish abroad, gastronomic, cultural, sports, art, etc.).

BeOS is a multicultural space where harmony, individual and collective growth and the sharing or participation of news, hobbies, events, competitions, photographs, videos, blogs etc ... and above all enhance human relationships and show the world the virtues of Spain.

BeOS is an essential social network, for all the millions of people who have Spain as a tourist destination, intend or have commercial relations with Her or simply like or want to know their customs and culture

It is also an excellent portal for all those people, who plan to make a trip abroad, can meet like-minded people and friends.

In the case of companies that want to export or offer quality Spanish services or products, they will previously have to contact the commercial department of BeOS, to authorize advertising, since BeOS certifies all the quality of the Spanish products that are promoted for its different websites, with the different quality control seals, such as “Best of Spain - Hospitality & Tourism” “Best of Spain - Spanish Gastronomic Embassy”, “Best of Spain - Services” “Best of Spain - Recommended Product"

1.1.- Registration need

It is mandatory to fill in all the fields that have an asterisk in the registration process, in order to access the website, when filling in this information the user is aware that they are offering personal data, as specified in the Privacy Policy

The data entered by the User must be current and truthful at all times.

The registered User will be responsible at all times for the custody of his password, assuming consequently any damages that could be derived from his improper use, as well as the assignment, revelation or loss thereof. For these purposes, access to restricted areas and / or the use of the services and contents carried out under the password of a registered User will be deemed performed by said Registered User, who will be responsible in any case for such access and use.

2.- Rules for using The BeOS Web

The User undertakes not to transmit, introduce, disseminate and make available to third parties, any type of material and information (data, content, messages, drawings, sound and image files, photographs, software, etc.) that are contrary to the law, morality, public order and these General Conditions. By way of example, and in no case limiting or excluding, the User undertakes to:

  • Take responsibility for all information shared with other users of The BeOS Web.
  • Do not enter content (images, videos) from third parties with or without your consent, all content must be from the profile.
  • Not to introduce or disseminate content or propaganda of a political, racist, xenophobic nature, of apology of terrorism or that threaten human rights.
  • Do not introduce or disseminate on the network data programs (viruses and harmful software) that may cause damage to the computer systems of the access provider, its suppliers or third party Users of the Internet network.
  • Not to disseminate, transmit or make available to third parties any type of information, element or content that undermines fundamental rights and public liberties recognized constitutionally and in international treaties.
  • Not to spread, transmit or make available to third parties any type of information, element or content that constitutes unlawful or unfair advertising.
  • Not requesting or offering professional contacts, any type of paid sex with money or bonuses of any kind is totally prohibited.
  • Do not impersonate other Users using their registration keys to the different services and / or contents of The BeOS Web.
  • Do not use third-party information (data, images, etc ...) to create fake profiles.
  • Do not transmit unsolicited advertising or, advertising material, "junk mail", "chain letters", "pyramid structures", or any other form of solicitation, except in those areas (such as commercial spaces) that have been exclusively designed for it.
  • Do not enter or disseminate any false, ambiguous or inaccurate information and content in a way that misleads the recipients of the information.
  • To maintain a profile adjusted to reality, the profiles are NOT modifiable: they have associated a series of non-transferable personal data (verifications, friendships, etc ...).
  • Treat the data shared on the website with the utmost confidentiality by other users.
  • Not to disseminate, transmit or make available to third parties any type of information, element or content that involves a violation of the secrecy of communications and data protection legislation.
  • Do not use third-party photos without your consent, generic internet photos, landscapes or drawings.
  • It is not allowed to publish external contact forms on the profile (WhatsApp, Mail, Telephone, Skype ...).
  • Advertising is not allowed through the profile of any kind, whether for profit or not. Unless previously authorized by us.

Failure to comply with any of these points will result in the immediate expulsion and cancellation of the BeOS account.

Additionally, the administrators of The BeOS Web reserve the right of admission, being able to cancel any account without prior notice even if none of the rules set forth herein is violated if they deem it appropriate.

3.- Modifications

BeOS reserves the right to modify, suspend, cancel or restrict the content of the website, its design and the links contained without prior notice.

4.- Disclaimer

BeOS does not guarantee the absence of errors in the access or content of The BeOS Web, nor that they are updated, although BeOS will make every effort to avoid them, correct them or keep their information updated.

BeOS is not responsible for any damages that may be caused to users' computers or systems due to possible computer viruses that may have been incurred due to user browsing on The BeOS Web.

The BeOS Web uses a TLS and SSL security certificate to ensure the authenticity of the server and the integrity and encryption of communications between the User and BeOS.

8.- Intellectual property

All the contents of The BeOS Web, understood by them, by way of example, the texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or sound content, as well as their graphic design and source codes, are Intellectual property of BeOS or third parties, without any of the exploitation rights recognized by current regulations on intellectual property on them being assigned to the User.

 The trademarks, trade names or distinctive signs are owned by BeOS or third parties, without it being understood that access to The BeOS Web attributes any right over them.

By accepting these General Conditions, the User gives BeOS, free of charge and exclusively, all exploitation rights over the articles, comments and opinions that the User publishes or whose publication is authorized on The BeOS Web. Said assignment shall be deemed to have been made for the world territorial area, without any limitation, and for the maximum period of time provided for in Royal Legislative Decree 1/1996, of April 12, which approves the Consolidated Text of the Property Law Intellectual, regularizing, clarifying and harmonizing the legal provisions in force on the subject.

The User, who claims to have all the intellectual property rights over the aforementioned articles, comments and opinions, undertakes to assume any claim or liability, including compensation for damages, that any third party may exercise against BeOS for considering their rights infringed rights for any of the actions derived from the obligations that the User contracts directly or indirectly with these General Conditions.

Likewise, the User undertakes to keep BeOS harmless against any damage that he or a third party may suffer as a result of the formalization of the transfer of rights regulated in this clause.

9.- Payment accounts

The BeOS Web has some paid services. The conditions and details of the payment service are detailed below:

  1. The BeOS Web may have different membership fees. The administrators of The BeOS Web reserve the right to raise or lower this fee at any time, as well as to offer discounts on it based on temporary offers or special situations.
  2. The Stripe or PayPal payment platform is accepted as payment methods. In any case, BeOS never stores bank information of any user, and cannot be held responsible for any misuse they may have.   3. The BeOS Community will never ask for credit card details and asks you not to enter them in any of our forms.
  4. Premium membership or other variants is for companies that want to advertise in the "Directories" module. For a period of one month, which will be renewed automatically, if the user does not notify otherwise within a stipulated minimum period.
  5. In case of paying by credit card, the payment will appear on the user's bank statement as BeOS.
  6. The voluntary withdrawal of an account, or expulsion for violation of the conditions of use, will not imply at any time the total or partial refund of the fee paid, regardless of the time remaining until the next payment.
  7. All advertising companies will have free and unlimited advice from our team, to configure their advertising in the best possible way.
  8. Individual users have a free basic membership for life, with which they can access and use all BeOS social tools and applications, except publish them in the Directory Section.

10.- Return Policy

The Premium user has a 15-day trial to learn about the "Directories" module, after this deadline, if the user wants to continue enjoying the services fully, he must pay the premium payment fee. Any claim from this point will be treated individually taking into account that the fee is non-refundable from the free trial period.

11.- Contents and services linked through The BeOS Web

The access service to The BeOS Web includes technical linking devices, directories and even search tools that allow the User to access other pages and Internet Portals (hereinafter, “Linked Sites”). In these cases, BeOS will only be responsible for the contents and services provided on the Linked Sites to the extent that it has effective knowledge of the illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, he may communicate it to BeOS without, in any case, this communication entails the obligation to remove the corresponding link.

In no case the existence of Linked Sites should presuppose the formalization of agreements with the managers or owners thereof, nor the recommendation, promotion or identification of BeOS with the manifestations, contents or services provided.

BeOS does not know the contents and services of the Linked Sites and, therefore, is not responsible for the damages caused by the illegality, quality, outdated, unavailability, error and uselessness of the contents and / or services of the Linked Sites, nor for any other damage that is not directly attributable to BeOS.

In the cases in which the User can access or be redirected to Linked Sites that allow the contracting of services and / or products, the User knows and accepts that BeOS acts as a mere intermediary facilitating said access, so it will not be responsible, nor indirectly nor subsidiary, of the damages of any nature derived from the free use and / or contracting of said services and products of third parties, as well as the lack of legality, reliability, usefulness, truthfulness, accuracy, completeness and topicality thereof . As an example, and in no case limiting, BeOS will not be liable for damages of any kind arising from defective compliance or breach of contractual commitments acquired by third parties; the performance of acts of unfair competition and illegal advertising; the inadequacy and disappointment of the expectations of said services and products of third parties and of the vices and defects of all kinds that may occur in them.

12.- Applicable Legislation and Jurisdiction

For the resolution of all disputes or issues related to The BeOS Web or the activities carried out therein, Spanish legislation will be applied, to which the parties expressly submit, being competent for the resolution of all derived conflicts or related to its use the Courts and Courts closest to Malaga. In the event that any clause of this document is declared void, the other clauses will remain in force and will be interpreted taking into account the will of the parties and the very purpose of these conditions.

Any breach of the rules of use will imply that the content in question can be deleted without prior notice.

The User is obliged to keep BeOS harmless against any possible claim, fine, penalty or penalty that may be forced to bear as a result of the User's failure to comply with any of the aforementioned rules of use, also reserving the right to request compensation for damages and losses that apply.
